ACCEPTABLE USE POLICY

 

Publisher Service agreement

Use of Doorwayto Business Solutions (DBS) Services

This Acceptable Use Policy ("Acceptable Use") is a guide to the acceptable use of Customer Accounts and the Services provided by Provider. It is an integral part of the Service Agreement entered into between Provider and Customer; any violation of this "Acceptable Use" is subject to sanction, including, without limitation, a warning E-mail, suspension of Customer's Account, or termination of Customer's Account, in Provider's sole discretion. During the term of your agreement with DBS you, as Subscriber, must ensure that your use of the services and products (collectively, the “Services”) provided by DBS conforms to DBS’s then current guidelines, policies, terms and conditions as described herein (collectively, the “Acceptable Use Policy”).  DBS may modify, without prior notice, the Acceptable Use Policy as DBS deems appropriate; such modified Acceptable Use Policy is effective upon posting on DBS’s Web site.  Your use of the Services and/or your maintenance of your DBS account shall be deemed an acceptance of this Acceptable Use Policy and any modification thereof.

As a DBS Subscriber you must agree to use the Services only for lawful purposes, in compliance with all applicable local, state and federal laws, rules, and regulations.  It is solely your responsibility to determine what laws, rules, and regulations are applicable to your use of the Services. The Subscriber of record shall be responsible for all use of the Services, whether or not that use is made with the knowledge or consent of Subscriber.

Provider reserves the right to monitor Customer's actions when necessary to determine whether or not Customer is violating the conditions of use.

This Acceptable Use Policy shall be used in conjunction with any other terms and conditions and agreements agreed to and accepted by you as a Subscriber of DBS’s Services.

Failure to comply with this Acceptable Use Policy may result in the termination of your account and the Services at any time without prior notice.  Violations of this Acceptable Use Policy could also subject Subscriber to civil and/or criminal liability.


Inappropriate Use
Subscriber is strictly prohibited from publishing, storing, posting, transmitting, re-transmitting, selling, distributing or otherwise disseminating on or through any of the Services which in the sole discretion of DBS is:

  • in violation of any local, state and federal or non-United States laws, rules, and regulations; 
  • threatening harm to any person or property or is otherwise harassing behavior or speech including, but not limited to, defamation and libel;
  • fraudulently representing other people, products or services;
  • adult or child pornography material, information, services or products;
  • in violation of the right of any person, including rights protected by copyright, trademark, trade secret, patent or other intellectual property or similar laws or regulations including, but not limited to, the installation or distribution of “pirated” or other software products that are not appropriately licensed for use by Subscriber;
  • materials and programs that contain viruses or Trojan software or tools to compromise the security of others;
  • any action that restricts or inhibits any person, whether such person is a DBS Subscriber or otherwise, in its use of DBS Services or its network;
  • “spam” or unsolicited commercial bulk mail or junk mail, news postings or chain letters, advertisements or otherwise making available any software, program, product, or service that is designed to facilitate sending unsolicited commercial bulk email; or
  • in the facilitation, aiding or abetting of any of the above activities or actions.


DBS will terminate, at its sole discretion, without prior notice, the DBS account of any Subscriber who uses the Services to market, sell or distribute any service or product that:

  • exploits sex to sell
  • promotes violence
  • promotes gambling; sweepstakes; raffles; lotteries; pyramids
  • is hateful in any way
  • is harassing or uses spam in any way, shape, or form
  • is libelous or defamatory
  • is threatening or abusive
  • is illegal or on the borderline
  • violates the intellectual property rights of others
  • is in such poor taste that DBS does not want the association.

Accounts that have been terminated as a result of abuse or violation of this Acceptable Use Policy shall not be reactivated and in the event of such termination Subscriber shall not be reimbursed for any fees paid to DBS for the Services.

Systems and Network Security
Subscriber is prohibited, without limitation, from utilizing DBS Services to compromise the security or tamper with system or network resources or accounts on computers at DBS or at any other site.  Use or distribution of tools designed for compromising security is prohibited.  Examples of such tools include, but are not limited to, the deliberate transmission of computer viruses, worms, Trojan software or other malicious programs into the network; password guessing programs, cracking tools or network probing tools.
DBS reserves the right to release the contact information of Subscribers involved in violations of network security to system administrators at other sites, in order to assist them in resolving security incidents.  DBS will also fully cooperate with law enforcement authorities in investigating suspected lawbreakers.


Indemnification
Subscriber agrees to indemnify, waive and hold DBS its parents, subsidiaries, affiliates, directors, officers, employees, agents and contractors, harmless from any and all claims and expenses arising out of or related a Subscriber’s violation of this Acceptable Use Policy, including any abusive or unlawful behavior on the part of Subscriber or any person using Subscriber’s account or the infringement of any intellectual property or privacy rights of any person or entity.  Subscriber cannot sue or recover damages whatsoever from DBS as a result of DBS’s decision, in its sole discretion, to remove material or data from its servers, suspend or terminate Subscriber’s account or take any other action during the investigation of a suspended violation or as a result of DBS’s conclusion that a violation of this Acceptable Use Policy has occurred.

Disclaimers
DBS disclaims all warranties, including warranty of merchantability, fitness for a particular purpose and non-infringement of third party rights.  DBS makes no warranties about the accuracy, reliability, completeness, or timeliness of the material, services, graphics, and/or links.  Neither DBS nor its parents, subsidiaries, affiliates, directors, officers, employees, agents and contractors will be liable for any damages whatsoever, including without limitation, any direct, indirect, incidental, consequential, special and exemplary damages, arising out of or related to the use or performance of this DBS network or its Web site or from any information, services or products represented or provided through DBS’s network or Web site, irrespective of whether such information, services or products are offered or furnished by DBS, its subscribers or third parties, even if DBS has been advised of such damages.  This Acceptable Use Policy and any and all other documents and information that are or may be published from time to time on this Web site may contain technical inaccuracies or typographical errors. DBS may, without prior notice to Subscriber, make improvements and/or changes in the documents, Services, products or programs described herein at any time.


Billing
Subscriber is responsible for timely payments.  Subscriber must provide current and accurate personal or corporate billing information.  It is solely Subscriber’s responsibility to ascertain that its accounts, as applicable, are up-to-date and current.  Payment for Services by fraudulent means, including without limitation, false names, unauthorized use of credit cards, or other falsified information will result in immediate and permanent termination of Subscriber’s account and possible criminal penalties.  Subscriber shall be charged an additional fee for any returned check, or unprocessed credit card charges. 
Failure by Subscriber to timely pay charges incurred may result in the cancellation of Subscriber’s account without any notice for non-payment.  DBS may also, in its sole discretion, charge interest, late fees and/or reactivation charges on a delinquent Subscriber’s account.

Payment and Cancellation
Each account is automatically renewed monthly or yearly as you first set up your account for an additional term upon your contract due date and the account balance is then debited from the credit card on file for your account. If you are a credit card paying client and the transaction is declined on your due date, a $0.50 fee will be applied against your current balance for each declined charge due to the late payment on your account. If at anytime you wish to cancel service you must send us an E-mail of your decision to cancel 48 hours before your next due date in order to avoid the automatic account renewal. There is no cancellation fee or penalty for terminating a hosting account. However, if you cancel your account after billing has occurred there is no refund for the remaining time unused.


Intellectual Property
Subscriber acknowledges and agrees that any and all copyrights, trademarks, service marks, patents, trade secrets and other proprietary rights and laws protect all content and materials made available on the DBS Web site.  Nothing contained on the DBS Web site shall be implied or deemed to confer any license or right to any intellectual property rights or license to any intellectual property, content, technology, system, process or other material belonging to DBS by virtue of being display or made accessible on any DBS Web site.  Except as expressly authorized by DBS, Subscriber agrees not to use the DBS network or the Services in any manner that would infringe, violate, dilute or misappropriate any such rights with respect to any material which Subscriber accesses through this Web site or the use of the Services. 

All DBS Property, including without limitation, all DBS Site Builder Web sites (text, logo, graphics, and scripting) and Trellix software programs are protected by United States intellectual property laws, including without limitation, copyright, patent and trade secrecy laws.  If any pages, information or content is copied, it may be only copied for non-commercial uses and DBS shall retain all copyright and other proprietary interests therein.

If Subscriber shall use a domain name in connection with the Services, Subscriber shall not use any domain name that violates any trademark, service mark or similar rights of any third party.

Privacy

DBS is committed to protecting your privacy. DBS will never sell personally identifiable information about you or your business to any third party without first receiving your permission, and all uses of any personally identifiable information about you or your business will be subject to our Privacy Policy.

Limitation on Liability

(a) YOU ARE SOLELY RESPONSIBLE FOR THE PROPER CONDUCT OF YOUR BUSINESS AND ALL OTHER MATTERS UNDER YOUR CONTROL. REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, YOU AGREE THAT IN NO EVENT WILL DBS, OUR AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OR LICENSORS, OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE DBS SERVICE, TECHNOLOGY, OR CONTENT AVAILABLE ON THE DBS SERVICE ("DBS AFFILIATES"), BE LIABLE TO YOU IN ANY MANNER WHATSOEVER:
(I) FOR ANY DECISION MADE OR ACTION OR NONACTION TAKEN BY YOU IN RELIANCE UPON THE INFORMATION PROVIDED THROUGH THE DBS SERVICE;
(II) FOR LOSS OR INACCURACY OF DATA OR COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES, OR TECHNOLOGY;
(III) FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUES AND LOSS OF PROFITS.

 (b) SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; IN THOSE JURISDICTIONS OUR LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

(c) IN NO EVENT IS DBS OR ANY DBS AFFILIATE LIABLE FOR ANY DAMAGES ARISING FROM YOUR FAILURE TO PERFORM YOUR RESPONSIBILITIES IN CONNECTION WITH THIS AGREEMENT, OR ARISING FROM ANY CAUSE BEYOND OWNSPOT'S CONTROL.

(d) This Agreement shall be governed by and construed in accordance with U.S. federal and South Carolina laws. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Any law or regulation that provides that the language of a contract shall be construed against the drafter shall not apply to this Agreement. You agree to submit to the exclusive jurisdiction of the federal and state courts of the state of South Carolina. If local laws prohibit your participation in any part of the DBS Service, or use of them, then you are responsible for complying with such laws and the terms of this Agreement.

 (d) If any provision(s) of this Agreement is held to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

All policies stated herein are subject to change without prior notice at DBS’s sole discretion.  Subscriber shall be responsible for adhering to any new policies implemented by DBSDBS reserves the right to inform Subscriber, from time to time, or otherwise post the changes, amendments, modifications or additions to  this Acceptable Use Policy, Terms and Conditions, and all other agreements and notices on the DBS Web site.

In order to maintain a high quality network for both publishers and advertisers, Doorwayto.com, Doorwayto Business Solutions, (DBS) and  DBS Site Builder personal monitors all network activity and does not accept any publishers whose Web site(s) or online activity does not comply with our Publisher Service Agreement. By accepting this agreement you agree to all terms of the Publisher Service agreement.

 

 Terms and Condition for Trial Account

If you wish to try the DBS Site Builder you can do so by Logging in as a new user. You do not need a merchant account or a domain name in order to use the trial account. 

Every trial account is effective for 30 days.  Within this period, you can opt to de-activate your trial account and decide not to continue with DBS Site Builder. After 30 days, if you have not yet de-activated your account, your account will be automatically de-activated. De-activated accounts not activated will be deleted from our database after a second 30 days.

 

To activate a trial account go back to our Rate page and purchase the package you would like to sign up under with your Login information.

 
You represent and warrant that you are over the age of 18 years, have read this Agreement, and agree to be bound by its terms and conditions.
